A True copy of Thomas Walker’s (1795 - 1851) WILL.

This is the last Will and Testament of me Thomas Walker of Darley in the Parish of Hampsthwaite in the County of York Yeoman. I appoint my Brothers John Walker, Benjamin Walker and Spence Walker Executors of this my Will, and to the survivor and survivors of them and their Heirs Executors and Administrators of the survivors of them. I direct my said Executors to pay all my just Debts, Funeral and Testamentary Expences out of my personal Estate. I give to my dear Wife, Ann for her own sole and separate use all my Household Furniture, China Plate and Linen. I give devise and bequeath unto my Son Spence Walker, his Heirs Executors, Administrators and Assigns forever all my Messuages, Tenements, Buildings, Lands, grounds and Hereditorments with their and every of their Appurtenances situate at Darley Carr which Estate was purchased by my late Brother Joseph Walker of the Executors of the late Stephen Downs (except the Moor Allotment). I also give and devise to my said Son Spence Walker his Heirs and Assigns that piece or parcel of land called the Calf Garth which I bought.of the Executors of the late William Metcalf subject to the payment of the yearly sum of ten Pounds unto my dear wife Ann or her assigns during the term of her natural life, or being married again which shall first happen, by half yearly payments the first payment thereof to begin and be made at the end of six Calendar Months next after my Decease, also subject to the payment of one Hundred Pounds unto my Daughter, Rachael Walker at her age of twenty five years.

I give devise and bequeath unto my Son Thomas Walker his Heirs Executors, Administrators and Assigns all my Messuages, Tenements, Buildings, Lands, Grounds and Hireditaments with their and every of their appurtenances situate in the Township of Menwith with Darley aforesaid, which I bought of the Executors of William Hudson, and also the Moor Allotment formerly the property of Stephen Downs, subject to the payment of the yearly Sum of ten Pounds unto my dear Wife Ann or her assigns during the term of her natural life, or until she be married again, which shall first happen by half yearly payments, the first payment thereof to begin and be made at the end of six Calendar Months next after my Decease and also charged and chargeable with and subject and liable to the payment of the Sum of four Hundred Pounds unto my Daughter Rachael Walker at her age of twenty five years my son Thomas Walker shall pay interest for the aforesaid sum of four Hundred Pounds after the Rate of four per Cent per Annum until my said Daughter, Rachael attain her age of twenty five years, the property bequeathed to him being subject thereto.

I give, devise and bequeath all my Messuages, Tenements, Buildings leans, grounds and Hereditaments with there and every of their appurtenances situate at Hanging Slade in the Parish of Hampsthwaite aforesaid, the Buildings and Land being in the occupation of Edward Mudd and the plantation ground in my own occupation unto my Sons Charles Walker and Joseph Walker and to his and their Heirs Executors, Administrators and Assigns respectively as Tenants in common and not as joint Tenants subject and chargeable with and liable to the payment of the Annuity or yearly Sum of fifteen Pound, unto my dear Wife, Ann, or her Assigns during the term of her natural Life or until her second marriage, which shall first happen by half yearly payments, the first payment thereof to begin and be made at the end of six Calendar Months next after my decease.

I give devise and bequeath all my Messuage, Tenements Buildings, Lands, Grounds and Hereditaments with their and every of their appurtenances situate at Hanging Slade in the Parish of Hampsthwaite aforesaid the Buildings and land being in the occupation of Edward Mudd and the planting ground in my own occupation unto my sons Charles Walker and Joseph Walker and to his and their Heirs, Executors, Administrators and Assigns respectively as Tenants in common and not as joint Tenants subject and chargeable with and liable to the payment of the Annuity or yearly Sum of fifteen Pound unto my dear wife Ann or her Assigns during the term of her natural life or until her second marriage which shall first happen by half yearly payments the first payment thereof to begin and be made at the end of six Calendar Month next after my decease.

I give devise and bequeath all my Messuage, Tenements, Buildings, Lands, Grounds and Hereditments with their and every of their appurtenances which my Brother Joseph Walker bought of the Executors of Thomas Petty, situate in the Township of Menwith with Darley aforesaid unto my son Samuel Walker his Heirs and Assigns forever, subject and liable to the payment of the. legacy or term of five Pounds yearly and every year unto my dear Wife, Ann, or her Assigns during the Term of her natural Life, or of her being married again, which may first happen by half yearly payments, the first payment thereof to begin and be made at the end of six Calendar Months, next after my decease.

All the rest of my real and personal Estate I give devise and bequeath unto my Son Robert Walker, his Heirs, Executors, Administrators and Assigns for ever subject to and chargeable with the Annuity or yearly Sum of twelve Pounds unto my dear Wife Ann or her Assigns during her natural Life, or until her marriage again which may first happen by half yearly payments. The first payment thereof to begin and be made at the end of six Calendar Months next after my decease and also subject to and charged and chargeable with the payment of the Legacy or Sum of four Hundred and fifty Pounds to each of my three following daughters, namely Mary Ann Walker, Sarah Walker and Maria Walker which I give and bequeath to them respectively , to be paid to them as they respectively attain the age of twenty one years, and I make my said aforesaid property chargeable with the payment of interest after the rate of four per cent per Annum for the said three Legacies until they respectively become due and payable.

I give devise and bequeath all my aforesaid real and personal Estate unto my Executors upon Trust during the minority of my said children that they shall lay out, apply and expend the clean Rents, Issues and profits of my said devised real and personal Estate in the Maintinance, Education support and clothing of my said Children and in putting them out to Trades and Callings at the discretion of my said Trustees, provided that in case any of my sons die under age and without Lawful Issue it is my Will and Mind that the Estate or Estates of such Child or Children so dying shall descend and go to the surviving Sons equally alike if more than one, but if only one then to such only Child. I make the Estate devised to my Son Spence Walker, liable to pay four Pound per Annum for the Interest of one Hundred Pounds charged upon the said Estate until my Daughter Rachael Walker attains her age of twenty five years.

And I do hereby revoke all Wills by me at any time heretofore made and publish this for my last Will and Testament. In Witness whereof I the said Thomas Walker the Testator have hereunto subscribed my Name this twenty fifth Day of January one Thousand eight Hundred and Forty eight.
